Pretrial intervention, also called PTI, is generally offered to first-time offenders. The program seeks to rehabilitate individuals rather than punish them. Successful completion of PTI results in no record of conviction. PTI can assist an individual in facing their personal problems, preventing future criminal activity and helping to avoid a criminal record.
Conditional dismissal takes place in the municipal courts and applies to nondrug related disorderly persons or petty disorderly persons offenses. Our law firm can assist with the application process and help present a solid case to the prosecution to prove that you are fit for the program. To participate in conditional dismissal, the individual must plead guilty to the charges and pay an application fee. The individual is placed on probation for typically a year. If he or she complies with the terms of probation, the charges can be dropped. Additionally, the arrest record can be expunged after six months.
Conditional discharge is a six to 24 month probation program specifically for marijuana offenses and other minor drug offenses. The individual must participate in random drug testing. Eligibility is limited solely to first-time offenders — you cannot have any prior drug convictions or participated in any other types of diversion programs. Similar to PTI and conditional dismissal, your record can be expunged after six months.
